Register a deed at the Registry of Deeds: your forms

You are registering a sale, a donation, or an estate settlement of titled land, and you need the sample instrument the Land Registration Authority publishes for that transaction.

Forms in this pack: Deed of absolute sale; Mandatory registration information (deed of sale); Donation inter vivos; Extrajudicial settlement of estate; Extrajudicial settlement with absolute sale; Affidavit of discrepancy; Special power of attorney; Petition to cancel a creditor's lien.

Deed of absolute sale: The downloadable-forms page links this sample. The paper opens with Deed of Absolute Sale.

Mandatory registration information (deed of sale): The 2021 LRA notice requires an MRI form for a deed of absolute sale. This blank is headed Mandatory Registration Information, transaction Deed of Absolute Sale, and cites LRA Circular No. 17-2021.

Donation inter vivos: The download page links a donation inter vivos sample. The page hosts two donation files; this is the one labelled donation. The paper says the donation takes effect during the donor's lifetime.

Extrajudicial settlement of estate: The download page's sample for an extrajudicial settlement of estate.

Extrajudicial settlement with absolute sale: The download page's sample that settles the estate and sells in the same instrument.

Affidavit of discrepancy: The download page lists Affidavit of Discrepancy. The paper is an affidavit that the technical description on an OCT or TCT is wrong.

Special power of attorney: The download page's sample special power of attorney to sell or mortgage titled land.

Petition to cancel a creditor's lien: The download page's petition for cancellation of a creditor's lien under section 4, Rule 74, addressed to the Register of Deeds.

At the Registry of Deeds the person completes a Transaction Application Form, and the basic papers are the original deed or instrument, a certified copy of the latest tax declaration, and, for titled land, the owner's duplicate of the title. That counter form is not a step here.

Issuance of a new title also asks for the BIR Certificate Authorizing Registration, a real-property-tax clearance, and proof of transfer tax, and, where the land is under CARP, a DAR clearance and the transferee's affidavit of landholding.

The 2021 notice requires an MRI form for a deed of absolute sale, a real-estate mortgage, its cancellation, and a donation. The MRI blank in this pack is the deed-of-sale form.

Not for: A contested estate, which needs a lawyer. A certified true copy of a title is a different request, through the Registry of Deeds or eSerbisyo.

Not affiliated with BIR, SSS, PhilHealth, Pag-IBIG or any government agency.
